The land advertised in this package is not owned by B1 Homes and can be purchased directly from the Developer/Owner. B1 Homes may receive a marketing referral from the Developer/Owner of the land and this may or may not be credited towards the house and land package. B1 Homes have authority by the land owner to include the land price for demonstrational purposes only. B1 Homes works closely with the Developer and/or their Selling Agent and will gladly assist to offer a similar sized & priced lot and the package prices adjusted accordingly. The house design may vary to comply with design guidelines, DAP’s, estate covenants or any other land developer requirements. Any cost associations for the changes that might be needed will be paid for by the purchaser. A Lump Sum Build Contract (LSBC) contract will be entered into with B1 Homes for the home construction and site works, and a separate land contract must be entered into with the partnered developer as B1 Homes do not own the land.

Home Loan applications are subject to lenders approval.This is a guide only and each application needs to be assessed to ensure it is in the best interest of the borrower and their circumstances. Repayments are based on the above house and land package purchase price minus 6% deposit and $10,000 First Home Owners Grant. First Homers grant is subject to approval by Office of State Revenue WA. Loan Repayments are based on a principle and interest repayment First Home Owner loan on a variable rate of 3.88% over a 30 Year Loan Term. The interest rate is effective 03/10/2018 and is subject to change. Lenders Mortgage Insurance has been included, other fees & charges may be required.

RENT REMOVER PROMOTION
In these Terms & Conditions the following terms shall have the following meanings:
Borrower means one or more individual borrowers under the Lending Agreement, or otherwise referred to as the Owner in the HIA Building Contract;
Builder means Pure Homes Pty Ltd ACN (152 100 251) T/A B1 Homes;
Deposit means the amount required by an authorised financial institution in Australia as a deposit;
HIA Building Contract means the HBCA Lump Sum Building Contract between the Builder and the Owner;
Financier means SPG Finance Pty Ltd ACN (151 558 539) T/A as Lets Finance;
Lending Agreement means the loan agreement and accompanying documents entered into by Lets Finance and the Borrower;
Loan Amount means the loan amount approved under the Lending Agreement;
Loan Application means the loan application submitted by the Applicant;
Owner means the owner as defined in the HIA Building Contract;
Party means a party to these terms and conditions and Parties has a corresponding meaning;
Promotion means Rent Remover
Promo Home means any home design advertised or marketed by B1 Homes as such;
Terms & Conditions mean these terms and conditions for the Promotion;
The Works has the same meaning as defined in the HIA Building Contract.
1 SELECTION CRITERIA
All persons named on the HIA Building Contract must:
(a) qualify for the WA First Home Owners’ Grant;
(b) enter into a HIA Building Contract with B1 Homes for any home with the exception of a promo home as advertised by B1 Homes; and
(c) obtain formal finance approval through Lets Finance (unconditional approval) to commence construction to HIA Building Contract value within 6 months of signing these Terms & Conditions
1.2 The Builder reserves the right to:
(a) withdraw or change the terms of this Promotion, or these Terms & Conditions, without notice; and
(b) refuse to provide, suspend or cancel the Promotion to any particular Owner or Borrower in the event that the Owner or Borrower does not comply with these Terms & Conditions.
1.3 An Owner or Borrower is only eligible to receive the benefits under the Rent Remover promotion noted within clause 2 to a maximum value of Australian eight thousand dollars (AUD $8,000.00).
2.1 Rent Remover Promotion:
(a) The purpose of the Rent Remover Promotion is to assist an Owner who can afford to pay the Deposit, and would like help paying their rent and meet the payment obligations under a HIA Building Contract. The Promotion is designed to provide assistance with rental payments during the course of construction.
(b) Within 30 days of receiving the Slab Down Payment which forms part of the HIA Building Contract, the Builder will pay fortnightly the amount equivalent to the value of the rental obligations due to be paid the Owner through the course of construction (to a maximum value of AUD $800.00 per fortnight) into a bank account nominated by the Borrower.
(c) The amount of rental assistance paid is:
i. based on written evidence of the owners’ current rental obligations up to the maximum value of AUD $400.00 per week; and
ii. for twenty (20) weeks from the Slab Down stage to when The Works reach the Practical Completion Inspection stage as defined in the HIA Building Contract.
iii. The maximum amount paid for this promotion will be to a value of AUD $8,000.00 based on clause 2.1 (c) i. and ii.
(d) Notwithstanding clause 2.1(a), the Owner may use the Rent Remover payment to make any other payments or for any other purpose as they desire.
(e) Any extension or delay caused by the Builder to The Works under the HIA Building contract will entitle the Owner to an adjustment of the value of the Rent Remover promotion (to a maximum of a further AUD$2,000).
(f) Any extension or delay caused by the Owner to The Works under the HIA Building contract will not entitle the Owner to any additional payments under the Rent Remover promotion.
3.1 If the HIA Building Contract is terminated, the following applies:
(a) by the Owner for any reason, then the Owner agrees to refund the full value of any payment or monies received from the Builder under this Promotion, to the Builder within thirty (30) days from termination; or
(b) by the Builder only to the extent that the Owner is in breach of the HIA Building Contract or those Terms & Conditions, and through no fault of the Builder, then the Owner agrees to refund the full value of any payment or monies received from the Builder under this Promotion, to the Builder within thirty (30) days from termination.
4 RELATIONSHIP DISCLOSURE
4.1 Pure Homes Pty Ltd ACN (152 100 251) T/A B1 Homes is a home building business owned by Scott Park Group Pty Ltd ACN 118 798 253.
4.2 SPG Finance Pty Ltd ACN (ACN 151 558 539) T/A Lets Finance (ACN 151 558 539) is an authorised credit representative (Number 421017) of Vow Financial Pty Ltd (Australian Credit Licence Number 390261). Lets Finance is a related body corporate of Scott Park Group Pty Ltd pursuant to the Corporations Act 2011 (Cth).
5.1 The HIA Building Contract value will be priced locked by B1 Homes for a total of twenty six (26) weeks from the date of signing these Terms & Conditions.
5.2 The Builder and/or Lets Finance make no representation or warranty about the availability and suitability of any financial products or options provided by Financier, and the Owner or customers are encouraged to read and understand any relevant product disclosure statement, or seek independent financial or legal advice.
5.3 The Applicant must satisfy all lender deposit and servicing requirements to seek approval of a home loan based on the HIA Building Contract entered into by the builder and the applicant. Amounts paid to the applicant on behalf of the Rent Remover promotion are not included in determining the suitability of the borrower by the lender.
5.4 The Applicant and/or the Borrower agree and acknowledge that:
(a) the Builder is not a licenced credit provider and does not engage in credit activities or provide financial services relating to credit contract; and
(b) they are encouraged to read and understand any relevant product disclosure statement provided by Lets Finance and/or the relevant lending institution, and seek independent financial or legal advice.
20 WEEK BUILD TIME GUARANTEE TERMS AND CONDITIONS
CONDITIONS OF ELIGIBILITY
Your home will be eligible for the 20 Week Build Time Guarantee (Guarantee Build Time) if the proposed house fulfils the following conditions:
• The house is one of our standard single storey designs with no modifications (excluding Strata builds and the following two storey designs – Avenue, Chelsea, Swan V1 and Swan V2)
• The house is located within the highlighted area of the attached map
• Contract value up to $250 000.
TERMS OF THE GUARANTEE
Should your home qualify, then B1 Homes will guarantee to complete the construction of your home within twenty (20) business weeks from the completion of slab pour. A Business Week is regular trading hours between Monday to Friday, excluding weekends, public holidays and the Christmas closure. This Build Time Guarantee should be read in conjunction with your Building Contract. Particularly Clause 9, which details the conditions around “Time for Performance”, which also apply to your Build Time Guarantee.
EFFECT OF BREACH OF THE GUARANTEE BUILD TIME
If the Guarantee is not met, B1 Homes will pay you $350 for each complete week from the expiration of the Guaranteed Build Time until the day construction of the house concludes, for a maximum of ten (10) weeks. Such payment will be the full extent of B1 Home’s liability to you for failing to meet the Guarantee. Penalty payments will be deducted from the final progress payment which is due after practical completion.
